Ben Weeks achieves successful outcome in non-molestation application.

Ben Weeks recently achieved a successful outcome for a client facing an application for a non-molestation order brought by a family member. The client, a vulnerable young woman, had endured sustained control, emotional, and financial abuse while living with her family. The non-molestation order appeared to be an extension of this abusive behaviour.

On the morning of the final hearing, the applicant withdrew their application, having failed to submit any supporting evidence despite a court order issued in October. Ben highlighted to the Court that the applicant’s non-compliance with this order underscored their lack of evidence and suggested that persisting with the application to the day of trial was a further attempt to exert control over the respondent.

In response, Ben successfully made an oral application for a non-molestation order to protect his client and secured an order for wasted costs against the applicant’s Solicitor.
