Ben Weeks secures conviction in multi-day child cruelty case.

Ben Weeks has successfully secured convictions in a complex three-day child cruelty trial involving offences under section 1 of the Children and Young Persons Act 1933.

 

The defendant in this case was a mother. Her son contacted the police and made allegations of physical violence by his mother on two separate occasions. Following a police investigation, the mother was charged with two counts of wilful assault of a child under the age of 16, contrary to section 1 of the Children and Young Persons Act 1933.

 

The case involved complex immigration issues relating to the family's visa status, including whether the prosecution and any subsequent conviction of the mother could affect the complainant's and the family's right to remain in the United Kingdom. This in turn raised questions regarding of whether prosecution would be in the public interest. Ben advised in conference on these issues, together with a number of other evidential matters.

 

The trial took place before District Judge Gould at Sheffield Magistrates' Court and lasted three days. It involved multiple witnesses, including child witnesses, the presentation of video-recorded evidence, and detailed cross-examination of the defendant.

 

The defendant was convicted on both counts. The case has been committed to the Crown Court for sentence.
