Gail Farrington achieves success in Financial Remedy proceedings.

Gail Farrington achieved a successful outcome for a wife in long running Financial Remedy proceedings.  The parties had been in a relationship for some 30 years, however, the husband had consistently refused to participate in the proceedings leaving the wife to incur considerable legal fees in having to pursue the matter through the courts.

 

The court determined that the wife should achieve at least one half of the net sale proceeds of the family home (the only asset) which was fixed at a figure to ensure this amount was received in the event of a reduction in the sale price of the property.

 

The court further concluded that the husband’s litigation conduct could not be ignored and that whilst the starting point was each party should bear their own costs, in this case the litigation conduct of the husband justified him being ordered to pay all of the wife’s legal costs amounting to some £17,000.
