Ashley Lambert-Jefferson successful in financial remedy cases.

Mr Lambert-Jefferson has a developing expertise in financial remedy cases. At the forefront of one case this year, the court had to grapple with deciding whether the lion’s share of the equity in a former family home was attributable to a family member and therefore not an available matrimonial asset for division between husband and wife. This involved complex issues of implied, express and common intention trusts.

In another case, Mr Lambert-Jefferson represented the husband where the appropriate division of the husband’s Armed Forces Pension on divorce was the central issue. The issue came before the court after a long marriage of 30 years and the husband’s pension was the most significant asset at issue. The husband was able to avoid the additional significant expense and delay of a contested final hearing after an effective FDR when the case was settled.

Mr Lambert-Jefferson was instructed in another pension case where the husband’s Teacher’s Pension was at stake. Following careful analysis of the actuarial calculations involved in the expert report Mr Lambert-Jefferson was able to guide the husband towards a settlement that appropriately protected the husband’s pension but achieved a fair balance between the parties.
